Bill 47: Making Ontario Open for Business Act, 2018, amends Bill 148 effective January 1, 2019

Bill 47, the Making Ontario Open for Business Act, 2018, received Royal Assent on November 21, 2018. This means that Bill 47 is now law, and will amend the Employment Standards Act, 2000 (the "ESA").  The amendments to the ESA will come into force on January 1, 2019.

Bill 47 will repeal many of the changes that were introduced by Bill 148.  Some of the changes to be repealed include:

  • an additional minimum wage increase to $15 per hour;
  • provisions providing for 10 Personal Emergency Leave days for all employees in the province, the first two of which are paid; and
  • equal pay for equal work based on employment status. 

It is important to note that employers must continue to comply with the Bill 148 ESA changes until the end of the year.

Certain provisions introduced by Bill 148 will remain in effect and are not impacted by Bill 47.
